TERMS OF USE AND SALE MAKE.HEAD

These Terms govern the use of the website www.makehead.eu and the purchase of MAKE.HEAD products. By placing an order or using the website, the customer agrees to these Terms.

2. Scope of Application

These Terms apply to all purchases, orders, and use of the MAKE.HEAD website. MAKE.HEAD reserves the right to update these Terms by publishing the latest version on the website.

3. Customer Eligibility
The customer confirms that they:

  •   are at least 16 years old;

  •   have the legal capacity to enter into binding agreements;

  •   provide accurate and complete information.

    4. Products

    MAKE.HEAD offers cosmetics, fragrances, beauty, and lifestyle products. Product descriptions, images, and packaging may vary slightly depending on production batches, country-specific requirements, device settings, and manufacturer updates.

    MAKE.HEAD reserves the right to:

  •   discontinue products;

  •   limit quantities per order;

  •   change prices;

  •   refuse orders for legal or operational reasons.

5. Professional Use of Certain Products

Some products available on the MAKE.HEAD website are intended exclusively for professional use. Relevant information is indicated on the product packaging, labeling, instructions, product descriptions, or product pages.

  •   Customers must read all instructions, warnings, and manufacturer recommendations before use;

  •   professional products must be used only for their intended purpose and by appropriately qualified individuals;

  •   MAKE.HEAD is not responsible for misuse, failure to follow instructions, or use of professional products by unqualified persons.

     

6. Prices and Currency

All prices on the website are listed in EUR unless otherwise stated. Prices may include or exclude VAT depending on the customer’s location and applicable legislation.

  •   Customers outside the EU may be responsible for import duties, customs fees, local taxes, and clearance charges;

  •   MAKE.HEAD is not responsible for exchange rate fluctuations or bank fees.

7. Orders

After placing an order, the customer will receive an email confirmation. Orders cannot be canceled once shipped.

MAKE.HEAD reserves the right to:

  •   refuse or cancel orders;

  •   limit product quantities;

  •   request additional verification;

  •   cancel suspicious or fraudulent transactions.

8. Payments

MAKE.HEAD may accept payments via Stripe, PayPal, Apple Pay, bank cards, and connected banking/payment providers. Payment information is securely processed through third-party PCI- compliant providers. MAKE.HEAD does not store full bank card details.

9. Shipping and International Destinations

MAKE.HEAD ships to countries within the European Union, selected European countries outside the EU, the United Kingdom, Switzerland, Norway, Serbia, Turkey, and the United Arab Emirates.

MAKE.HEAD is also expanding certification and regulatory compliance for the United States, Brazil, selected Latin American countries, and South Africa.

Shipping availability depends on local regulations, customs requirements, carrier restrictions, fragrance transportation limitations, and product category. MAKE.HEAD reserves the right to limit or refuse shipping to certain countries.

10. Fragrance Shipping Restrictions

Certain fragrance and alcohol-based products may be subject to shipping restrictions due to aviation regulations, customs laws, and dangerous goods transportation policies. MAKE.HEAD reserves the right to remove restricted products from orders or cancel shipments.

11. Returns and Refunds

  •   Customers may request a return within 14 calendar days after receiving the order;

  •   products must be unused, unopened, in original packaging, and with intact protective

    seals;

  •   opened cosmetics, skincare products, fragrances, hygiene-sensitive items, and used

    products cannot be returned;

  •   return shipping costs are paid by the customer unless the product is defective, damaged,

    or incorrectly supplied by MAKE.HEAD;

  •   refunds are issued after inspection and approval of the returned goods.

     

12. Damaged or Incorrect Products

Damaged, defective, or incorrect products must be reported within 48 hours after delivery. MAKE.HEAD may request photos of the product, packaging, shipping label, or other supporting evidence.

13. Refused Shipments

If a shipment is refused by the customer, customs authorities, or the carrier, MAKE.HEAD may deduct shipping fees, customs costs, storage fees, and return handling costs from the refund amount.

14. Customer Accounts

Customers are responsible for maintaining the confidentiality of their account credentials and passwords. MAKE.HEAD reserves the right to suspend or terminate accounts in cases of suspected fraud, abuse, or violation of these Terms.

15. Intellectual Property

All website materials, including trademarks, logos, product photography, descriptions, graphics, design, and text, are owned by MAKE.HEAD or its licensors. Unauthorized use is prohibited.

16. Anti-Resale Policy

MAKE.HEAD products are intended for personal use or authorized professional use only. Unauthorized resale, marketplace resale, unauthorized retail distribution, and gray market activity are prohibited and may result in order cancellation or service restrictions.

17. Product Liability and Usage

Individual reactions to cosmetic and fragrance products may vary. Customers are responsible for reviewing ingredients, warnings, and usage instructions. MAKE.HEAD recommends performing a patch test before using new products, especially professional products and products containing active ingredients.

18. Export Control, Sanctions, and International Restrictions

MAKE.HEAD reserves the right to cancel orders and refuse transactions where the sale or shipment may violate export control laws, sanctions regulations, customs legislation, or international trade restrictions.

19. Fraud Prevention and Security

MAKE.HEAD uses anti-fraud technologies and may request additional verification, delay shipments, cancel orders, or restrict access in cases of suspected fraud, chargeback abuse, or unauthorized payment activity.

20. Limitation of Liability

To the fullest extent permitted by law, MAKE.HEAD shall not be liable for indirect damages, incidental damages, delays, loss of profits, customs delays, carrier failures, or force majeure events.

Nothing in these Terms limits mandatory consumer rights under applicable law.

21. Force Majeure

MAKE.HEAD shall not be liable for delays or failure to perform resulting from natural disasters, war, strikes, pandemics, governmental actions, transportation disruptions, internet failures, or customs restrictions.

22. Privacy and Data Protection

Personal data is processed in accordance with the MAKE.HEAD Privacy Policy and applicable GDPR legislation.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes shall be subject to the jurisdiction of the courts of Barcelona, Spain, unless otherwise required by mandatory consumer protection legislation.
